Information Statement pursuant to Article 13 of EU Data Protection Regulation 2016/679

Dear Sir/Madam,

We wish to inform you that the EU Data Protection Regulation 2016/679 ("European Regulation on Personal Data Protection") protects the rights of people and other entities while ensuring compliance of personal data processing. Therefore, in compliance with Article 13, we inform you of the following:

1. Intended purpose and legal basis of personal data processing

a) The personal data that you provided will be processed for the only purpose of fulfilling the contractual obligations as well as to fulfil your specified requests and obligations of law and in particular the accounting and tax obligations required by our business.

2. Processing methods

Your personal data is subject to manual and computerised processing in order to fulfil the above purposes. Processing tasks are implemented in such a manner as to guarantee the logistical, physical security and confidentiality of your personal data.

3. Legitimate interests pursued by the data controller or by third parties

The legitimate interests pursued by the data controller in processing the data lies in having to comply and fulfil the contractual obligations assumed by the parties.

4. Nature of personal data

Your personal data is subject to processing in order to fulfil the services you requested.

5. Mandatory and optional provision of personal data

Your personal data is processed without your consent when it is mandatory in order to fulfil pre-contractual, contractual and tax obligations, as well as to fulfil obligations of law, rules, EU laws or orders by competent authorities, or to exercise the data controller's rights, for example the right of defence in legal proceedings.

6. Scope of disclosure and dissemination of personal data

Your personal data may be communicated to:

· all those who have the right to access said data pursuant to regulatory provisions;

· to our collaborators and employees in order to fulfil their respective duties;

· to all natural or legal persons, public or private, whenever disclosure is necessary or whenever is instrumental to fulfilling our activities in the manner and for the purposes outlined above, for example: to banks, insurance companies, certification bodies, control entities, credit collection companies, etc.

7. Transferring personal data to a third-party country

Personal data will not be subject to transfer outside the European Union.

8. Preservation methods and duration of personal data

Your personal data will be preserved for the time strictly necessary. In particular, tax and accounting data will be preserved for 10 years after the end of the contract.

9. Existence of an automated decision-making process

There is no automated decision-making process.

11. Rights of the data subject

11.1 Article 15 (Right of access), Article 16 (Right to rectification) of the EU Data Protection Regulation 2016/679

The data subject has the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information outlined in this informative statement.

11.2 Rights envisaged in Article 17 of the EU Regulation 2016/679 - Right to erasure (“Right to be forgotten”)

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

b) the data subject withdraws consent on which the processing is based according to Article 6, section 1, letter (a) or Article 9, section 2, letter (a) and where there is no other legal ground for the processing;

c) the data subject objects to the processing pursuant to Article 21, paragraph 1 and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21, paragraph 2;

d) the personal data have been unlawfully processed;

e) the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject;

f) the personal data have been collected in relation to the offer of information society services referred to in Article 8, paragraph 1 of the EU Data Protection Regulation 2016/679.

11.3 Rights envisaged in Article 18 - Right to restriction of processing

The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:

a) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;

b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;

c) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;

d) the data subject has objected to processing pursuant to Article 21, paragraph 1 of the EU Regulation 2016/679 pending the verification whether the legitimate grounds of the controller override those of the data subject.

11.4 Right envisaged in Article 20 - Right to data portability

The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided.

12. Withdraw from the consent to process the personal data

The data subject has the right to withdraw his/her consent at any time without prejudice to the lawfulness of the processing based on the consent provided prior to the withdrawal.

You have the right to withdraw your consent to process your personal data by sending a certified email to the following address: bulloneriabellicini@pec.sintesys.eu, along with a photocopy of your identification document with the following text: “withdraw my consent to process my personal data”. After completing the above, your personal data will be removed from the archives as soon as possible.
